General Terms and Conditions

§1 The detective agency obliges itself to carry out the contract placed after best knowledge and conscience and with the business usual care.Extended liability for the detective agency and its employees is excluded.Particularly the detective agency's isn’t liable for decisions which are put due to their inquiries.

§2 The manner of the execution of the placed contract is determined exclusively by the detective agency in a dutiful estimation.

§3 The detective agency will keep silence about all information which are confessed against third parties, except the client releases the detective agency of the pledge of secrecy in writing. This also applies to its employees.

§4 The detective agency obliges itself to give at least one reporting in written form as far as not agreed differently.

§5 The reports, video materials as well as pictures only have for the client meantly and of this to be dealt strictly confidentially.Any passing on to third parties without consent of the detective agency is forbidden.The client is legally responsible to the detective agency at an agreement adverse use or passing on to third parties.

§6 The client doesn't have any claim to announcement of the informers of the detective agency.

§7 All prices and fees are plus the legal value added tax.

§8 As far as nothing else was agreed, the detective agency calculates at the hourly rate additional night surcharges (30% from 21.00pm to 06.00am) as well as Sunday- and holiday surcharges (50%).Additional surcharges are left for abroad work.The handling can be made dependent by an adequate advance payment.After consumption of the advance the detective agency can interrupt the work until the new advance payment.At transgression of the period of payment the bank usual default interest gets due without it requiring a reminder.

§9 Invoices assigned after rendered service are immediately and without every discount due for the payment.The final report is sent after a complete payment of the invoice.

§10 Supplementary agreements require the in writing in every case.

§11 The client insures with his signature that his details on his legitimate interest correspond to the facts and neither illegal or immoral nor the security of the state threatening aims are followed up.

§12 The client obliges himself not to get active in this matter or to let third parties get active for the duration of the contract.

§13 In the context of a placed contract the detective agency mustn't get active against the interests of the client.If an interest collision arises in the course of the execution of the contract, then the detective agency may give the mandate back under reference to it.

§14 If the detective agency because of execution of the contract in processes or other proceedings is taken up by the hearing or written reporting , then the client is engaged to reimburse the detective agency for the time expenditure and the expenses in accordance with the rates.Reimbursements for the demands paid by the court have to be credited to the remuneration.

§15 At an premature contract cancellation by the client the costs accrued till then are due plus a cost compensation of 10% of the contract sum for the payment.By cancellation of an contract not processed yet being charged to 30% of the contract sum as cancellation charges.The assertion of a further confidence damage isn't excluded.

§16 Clients or detective agency can call the impartial and arbitrational decision of the office of Bundesverband Deutscher Detektive e.V., in case of conflict.The decision going out there shall be considered obligatory.Process of law by circuit courts isn't excluded.

§17 The guarantee period amounts to 1 year.

§18 The client(s) agree, that case-related data is recorded.Also case-related personal data, if necessary.After expiry of the legal periods these are deleted, however.

§19 If particular positions of this terms and conditions should be get inadmissible or ineffective, the effectiveness of the other positions isn't touched by this, as far as these still meet the meaning and purpose of the contract standing alone for themselves.The ineffective position shall be replaced or completed by such a one, which comes for the economic purpose of the contract at the next.

§20 Place of performance and jurisdiction is Laupheim.
